Woman Refuses to Allow Father to See Children, Despite Child Custody Order; What You Can Do if You are Facing a Child Custody Dispute in Chicago

A Mitchell, Indiana woman was arrested last weekend following a child custody dispute that she had with the father of her children earlier this year on March 8. According to local Indiana news reports, WBIW, in March, 31-year-old mother of three Danielle Livingston refused to follow the court-ordered child visitation agreement that is in place in her case, and would not allow her three children’s father to see them as regularly scheduled. Police officers were provided with text messages showing that Ms. Livingston was refusing to provide the children to their father, and informing him that if he wanted to see them, “he would have to take her to court.” Police then contacted Ms. Livingston, but she said that she would not let the children go with their father. Ms. Livingston claimed that the children’s father was “mentally abusive to the children”, but she was not able to provide law enforcement authorities with any specific details of the abuse. Ms. Livingston also told police that the children’s father had made comments regarding killing himself in front of the three children. Ms. Livingston, however, confirmed that she had never contacted the Department of Child Services or the police about the abuse.

In the end, Ms. Livingston continued to refuse to allow the children to see their father and, according to police, she “could not provide reasonable concerns about why the children could not visit their father.” Accordingly, after Ms. Livingston stopped answering police phone calls, a warrant was issued for her arrest for interference with child custody. Those criminal charges are now pending against Ms. Livingston.

Child Custody and Parental Child Abductions in Chicago

In Chicago, under Illinois child custody laws, parents are required to follow court-ordered child visitation schedules that detail when and how the children at issue are to see their parents subject to the order. When a parent violates a child custody order, the situation may rapidly become a case of parental child abduction. Accordingly, it is very important that parents act immediately if their ex-spouse or partner has violated a court-ordered child visitation schedule. Parents facing the violation of a child visitation order and withholding of their children from them should immediately contact an experienced Chicago child custody lawyer as soon as possible to discuss their rights, options, and next steps to get their child back safely.
