Chicago Girl, Age 13, Abducted by Mother, Non-Custodial Parent Child Abductions Explained

Abduction

Earlier this year, in February, news of a child who was abducted by her own mother in Chicago spread around local Chicago news outlets and put some divorced and separated parents on high alert about the issue of non-custodial parental child abductions in Illinois. According to local news reports, ABC 7 Eyewitness News, on Friday, February 6, 13-year-old teenage girl Aamaya Ken-Knox was abducted by her mother from a local Chicago-area hospital. Aamaya Ken-Knox’s mother does not have custody of the girl, and, in fact, she is a ward of the State of Illinois. Aamaya Ken-Knox was in the care of the local hospital at the time that she was abducted by her mother. Authorities indicate that Antoinette Knox, Aamaya Ken-Knox’s mother, entered the hospital on that Friday in February, signed her daughter out of the hospital, and left the hospital campus with her. Local law enforcement authorities report that the mother and daughter were last seen in the area of 25th Street and Western Avenue in Chicago. Police also released to the public that Antoinette Knox was known to spend time in Chicago’s second district. Unfortunately, since the 13-year-old girl was abducted back in February, there has been little in the way of news reports on whether she was located safely. At the time the news reports broke, investigators called for those who have information to contact Area 5 detectives with any tips.

Can a Biological Parent Really “Kidnap” Their Own Child under Illinois Laws?

It may sound unbelievable to some Chicago parents that the mother or father of a child can commit the crime of child abduction by taking their own child from another’s hands. However, the truth of the matter is that under Chicago child custody laws, a non-custodial parent, even if they are the biological parent of the child, cannot simply take their child from a person or party that has legal child custody of the child. This is called a non-custodial parental child abduction or a parental kidnapping.

When a Parent Kidnapping becomes an International Child Abduction

Things can take an even worse turn when a non-custodial parent abducts a child across international borders. Once overseas, it can be very challenging to locate a child that has been abducted and reunite them with their custodial parent. Accordingly, if you suspect that your ex is in the process of abducting your child it is important to act quickly for the best chance of locating and reuniting with your precious loved one. Under the international treaty the Hague Convention, Chicago parents may have rights and options to locate their child and return them home safely.
