Illinois Woman Hit with Criminal Charges After False Report Against Estranged Husband in Child Custody Battle

FamLaw5

What happens when a child custody battle is so heated that one parent decides to skirt the law in order to garner support for their side? The answer is that that parent may end up in hot water, and with criminal charges. This is what happened in a recent case in Illinois, and it serves as an example of what not to do in the midst of a child custody dispute. According to local news reports covering the story, earlier this September, a Lake County, Illinois mother was arrested and charged after she called 911 to falsely report violence against her children, who were staying with their father, her estranged husband. The woman, who is 39 years old, allegedly called police from her home in Lake County and told emergency dispatchers that “her estranged husband shot and killed her children.” The woman told dispatchers that her “oldest son had been shot and killed because his phone was disconnected, and she could no longer reach him.” However, when deputies arrived at the scene of the alleged shooting, the children were safe and were at school. During their investigation, police “determined [the mother] and her estranged husband were in a custody dispute at the time of the call, according to authorities.” The woman was ultimately charged with felony disorderly conduct, for making a false report to 911 dispatchers. The case is ongoing, and it remains to be seen if there will be a conviction in the case, or any other action.
